Business in Focus respects the privacy of our clients, website visitors, and those photographed during our assignments. This privacy policy outlines the personal data we process, our purposes for doing so, and your rights.

1. Who is responsible?

Business in Focus acts as the data controller for personal data processed for its own purposes, such as contact details, administration, website usage, and its own portfolio and promotional communications. For certain processing activities carried out solely on behalf of a client, the role of Business in Focus may vary depending on the circumstances.

Photography and Media Assets

During photography assignments, Business in Focus processes images in which individuals may be identifiable.

A photograph in which a person is recognizable or otherwise identifiable constitutes personal data under the GDPR.

Event photography may also involve processing event details necessary for the execution of the assignment, such as the names and titles of speakers, VIPs, or other individuals specifically requested in the brief.

Technical Data

When you use our website, limited technical data may be processed to ensure its functionality, security, and analysis.

5. What are our legal grounds for processing data?

As the organizer, the client is responsible for their own event obligations, including notifying attendees about photography when required by the nature of the event, the circumstances, or applicable regulations.

The client must inform Business in Focus in advance about:

  • individuals who should not be photographed;

  • specific privacy restrictions;

  • confidential segments of the event;

  • other circumstances Business in Focus must take into account when photographing.

Business in Focus will comply with all reasonable and actionable instructions.

This agreement does not exempt Business in Focus from its own obligations under applicable privacy and image rights regulations.

7. Portfolio and self-promotion

Business in Focus uses photography to provide potential clients with a clear and professional representation of our work and services.

This is why a curated selection of project visuals may be used for purposes such as:

  • the Business in Focus website and portfolio;

  • case studies;

  • LinkedIn and Instagram;

  • presentations and pitches;

  • industry publications and award submissions;

  • other Business in Focus marketing and business communications.

Our General Terms and Conditions state that Business in Focus may use a representative selection of the captured media for marketing purposes, unless the client explicitly restricts or excludes this in writing before the start of the project.

When selecting and publishing imagery, Business in Focus considers:

  • the nature of the assignment;

  • the context in which individuals were photographed;

  • confidential or sensitive business information;

  • reasonably identifiable interests of recognizable individuals.

A contractual agreement with a client does not override the rights of recognizably depicted individuals.

If an identifiably depicted person has a specific objection to Business in Focus using a photo, they can get in touch via info@businessinfocusphotography.nl. Business in Focus will assess the objection based on the circumstances of the case and applicable regulations.

8. Contact and intake forms

When someone reaches out through the website or requests an introductory meeting, Business in Focus processes the data required to handle the request.

This may include:

  • details about the event or photography assignment;

  • other information provided voluntarily.

We advise visitors to only share information necessary for their request.

9. Microsoft 365, Teams, and Bookings

Business in Focus relies on Microsoft 365 for key business services, including:

  • Microsoft Bookings;

When someone schedules a meeting via Microsoft Bookings or communicates with Business in Focus through Microsoft Teams, personal data such as name, email address, appointment details, and communication data may be processed.

10. Photo editing, storage, and delivery

Business in Focus uses digital services for purposes such as:

  • selection and post-processing of photography;

  • storage and back-up;

  • business administration;

  • file delivery to clients.

This may involve the processing of personal data by third-party service providers when necessary to deliver our services.

Business in Focus carefully selects suppliers based on strict safety and privacy standards, establishing data processing agreements whenever necessary.

11. Sharing of Personal Data

Business in Focus does not sell personal data to third parties.

Personal data is only shared when it is:

  • necessary to perform a contract or assignment;

  • necessary for business operations;

  • required to comply with a legal obligation; or

13. Website, analytics and cookies

Business in Focus uses Framer’s built-in analytics to monitor and optimize website performance and usage.

Framer Analytics does not use cookies or other persistent identifiers. According to Framer, it does not collect any data that can directly identify individual visitors. These analytics are used solely for aggregate insights, such as page views, traffic sources, devices, and locations.

Cookie consent is not requested as long as no data requiring prior consent is stored on or retrieved from a visitor's device.

If Business in Focus introduces technology in the future that requires consent—such as marketing pixels, remarketing tools, or non-essential tracking cookies—it will assess the necessary information and consent requirements prior to implementation.

This privacy policy and, if necessary, the website's cookie settings will then be updated accordingly.

14. Retention periods

Business in Focus does not retain personal data longer than necessary for the purposes for which it was collected, unless a longer retention period is legally required or reasonably necessary.

Contact and Inquiry Details

As a rule, data from inquiries and introductory meetings that do not lead to a contract will be deleted no later than 24 months after the last substantive contact, unless there is a specific reason to retain them longer.

Client and Project Details

Data required for project execution and administration is retained during the business relationship and thereafter for as long as reasonably necessary for administrative purposes, queries, potential disputes, and legal compliance.

Financial Administration

Data that is part of the tax administration is generally retained for 7 years, or longer if a statutory retention obligation applies.

Complete project files

As a rule, complete project files—including RAW and other files required for processing and any future delivery—will be archived for 12 months following delivery.

This allows for backups, potential follow-up deliveries, handling order inquiries, and recovering files if needed.

After this period, these files will be deleted unless a longer retention period is required for a specific case, such as an ongoing inquiry, dispute, or other legitimate reason.

Selected Final Images

Finalized and delivered images may be stored longer for archiving, subsequent requests, and to verify completed work.

Portfolio

Images lawfully used for Business in Focus's portfolio or promotional communications may be retained for as long as the relevant business purpose exists.

Rejected files

Unselected, duplicate, technical test, or rejected images will not be kept longer than reasonably necessary for selection, processing, backup, and project completion.

15. Security

Business in Focus takes appropriate technical and organizational measures to protect personal data against, among other things:

  • loss;

  • unauthorized access;

  • unauthorized alteration;

  • unwanted disclosure.

The measures taken are tailored to the nature and sensitivity of the data and the risks associated with the processing.

16. Your privacy rights

When Business in Focus processes personal data, the individual concerned may, depending on the circumstances, have the right to:

  • rectification;

  • erasure;

  • restriction of processing;

  • objection;
